The Pharmacy Council has developed and published a Naming Policy, as required by changes made to the Health Practitioners Competence Assurance Act (the Act) in 2019.
Section 157(1) of the Act provides Council with the discretion to publish a notice setting out the effect of any order or direction it has made in respect of a pharmacist; a summary of any finding it has made; and the name of the pharmacist concerned. Sections 157A- 157I set out the new requirements to publish a naming policy.
The Naming Policy sets out the principles and circumstances for Council to exercise powers under section 157(1) of the Act to publish a notice naming a pharmacist about whom any order or direction is made under the Act. The Policy considers Parliament’s expectation that health regulatory authorities are more transparent about their decisions but balancing this with regard to the pharmacist’s privacy interests.

Under section 69 of the Health Practitioners Competence Assurance Act, the Pharmacy Council has determined to suspend Ms Nee Nee Ong’s practising certificate because it has reasonable grounds to believe that information it has received casts doubt on the appropriateness of her conduct in her professional capacity.
